Regulations under the New Jersey Law Against Discrimination (LAD) protect individuals from discrimination based on sexual orientation. The LAD covers sexual orientation, transgender identities, and gender expressions.

Under New Jersey law, employees are protected from discriminatory practices based on “sexual or affectional orientation,” including:

Perceived Sexual Orientation

The LAD also protects against discrimination based on “perceived” sexual orientation. A notable case involved a police officer denied a promotion due to his supervisor’s incorrect perception of his sexual orientation, leading to a significant lawsuit settlement.

Legal Recourse

Individuals facing sexual orientation discrimination in New Jersey can seek redress through the New Jersey Division on Civil Rights within 180 days of the last discriminatory act or through legal action in the Superior Court within two years.
