NJ Employment Law – Parental Bereavement Act

The Parental Bereavement Act (“PBA”) was introduced in the Senate in July 2011.  The PBA would amend the Family and Medical Leave Act to protect leave taken by employees for the death of a child.  This is currently not protected by any Federal or State law in New Jersey.  However, many companies do have bereavement policies that allow employees to take leave for the death of a family member.  The PBA would only apply to employers that have 50 or more employees and may require the employee to work for the company for more than 2 years to be entitled to the leave.
