New Jersey’s Law Against Discrimination (LAD) protects individuals from discrimination based on sexual orientation, including transgender identities and gender expression. The New Jersey Division on Civil Rights (DCR) enforces these protections and prohibits employers from discrimination such as refusal to hire, termination, harassment, unequal pay, or other unfair treatment related to these characteristics.
The LAD also protects against discrimination based on perceived sexual orientation. For example, a New Jersey police officer won a settlement after being denied a promotion due to a supervisor’s mistaken assumption about his orientation.
Victims of sexual orientation discrimination in New Jersey have 180 days to file a complaint with the DCR or up to two years to pursue a lawsuit in Superior Court.
