Sexual Orientation LGBT
Regulations under the New Jersey Law Against Discrimination (LAD) protect against discrimination based on sexual orientation, covering transgender identities and gender expressions. Employees are shielded from discriminatory practices rooted in “sexual or affectional orientation,” which includes a range of attractions and identities.
Types of Sexual Orientations Protected
- Heterosexuality: Attraction to individuals of the opposite gender.
- Homosexuality: Attraction to individuals of the same gender.
- Bisexuality: Attraction to individuals of both genders.
- Transgender Identity: Gender identity or expression does not align with the sex assigned at birth.
- Gender Identity or Expression: An individual’s internal sense of gender or outward expression of gender.
Enforcement by the New Jersey Division on Civil Rights (DCR)
The DCR enforces LAD provisions, recognizing these protected categories of sexual orientation. Employers cannot engage in discriminatory actions such as refusal to hire, termination, harassment, disparate pay, or unequal treatment in terms of employment based on these characteristics.
Protection Against Perceived Discrimination
LAD also protects against discrimination based on perceived sexual orientation. For example, a police officer in New Jersey won a significant settlement after being denied a promotion due to his supervisor’s erroneous perception of his sexual orientation.
Legal Recourse
Individuals subjected to sexual orientation discrimination can seek redress through the New Jersey Division on Civil Rights within 180 days of the last discriminatory act or through the Superior Court within two years.
